Comes now LUCY IMPSON and shows to the Court that MORRIS IMPSON departed this life at Antlers, in the County of Pushmataha and State of Oklahoma on or about the 6th day of April, A. D. 1915. That said decedent was at the time of his death a resident of near Jumbo in the County of Pushmataha and State of Oklahoma. That said decedent left estate in the County of Pushmataha, State of Oklahoma. That due search and inquiry has been made to ascertain if decedent left a will but none has been found, and according to the best information and belief of petitioner, said decendent died intestate. That the general character and probable value of the estate left by decedent is as follows: An allotment of the lands of the Choctaw and Chickasaw Tribes of Indians, of the value of about $3,000.00. Horses, cattle, hogs and other personal property of above the value of $1,500.00. That the names, ages and residence of the heirs at law of the decedent so far as known to your petitioner, are as follows: LUCY IMPSON, wife, residence: Jumbo, Oklahoma. BEDFORD as administrator of the Estate of MORRIS IMPSON, deceased, there are 16 head of milk cows and 12 calves that are her own separate personal property; that she is a widow of the late MORRIS IMPSON; that these cattle claimed by her were never the property of the deceased and never claimed by him, though for convenience they were all in the same mark, and brand, that of the deceased. Now on this the 6th day of March, 1916, this being the day set for the hearing of the petition and application of LUCY IMPSON, widow of the decedent, MORRIS IMPSON, for an order directing the administrator, B. S. BEDFORD as administrator of the estate of MORRIS IMPSON, deceased, and it appearing to the Court on satisfactory proofs and the evidence that the necessary expenses of funeral and last sickness of said deceased, and of the administration of said estate have been fully paid, and that all the debts existing against said deceased, or allowed by the Court, pursuant to law, have been fully paid and satisfied, and that said estate has been fully adminstered, as by final account of B. S. BEDFORD, administrator of said estate, duly audited and allowed by this Court, and it appearing to the Court that due notice of the settlement of said final account has been given as provided by law; and it appearing that said B. S. BEDFORD has well and truly accounted for every part of said estate, and that no profit has been made by him through any increase in said estate, and there being no objections, and the Court being fully advised, it is ordered, adjudged and decreed by the Court, that the final account of the said B. S. BEDFORD, be and the same is hereby finally settled, allowed and adjusted by the Court according to the tenor and terms of said account herein filed, and it is further ordered, adjudged and decreed that said B. Comes now SOPHIA IMPSON and asks the Court to approve the contract entered into with TOM G. HAILE, attorney at law, by the terms of which they have employed the said TOM G. HAILE as their attorney to reduce to possession and cancel all outstanding deed and instruments adverse to their interest in and to the allotment of MORRIS IMPSON, Choctaw by Blood, said lands being described as follows: East half of Southwest quarter and West half of Southwest quarter of Section 22, Township 1 South, Range 15 East. A copy of which contract is hereto attached marked Exhibit "A" and made a part hereof. Your petitioner would state to the court that they acquired their interest in land as follows: AS AN HEIR OF THE DECEASED ALLOTTEE. That the lands above described were allotted and patented to the said MORRIS IMPSON and upon his death your petitioner inherited fee simple interest in said lands and they are entitled to the same at this time. Your petitioner would show that the said MORRIS IMPSON was at the time of his death a bonafide resident of Pushmataha County, State of Oklahoma, and that this Court has jurisdiction over the settlement of his estate. Your petitioner would further state that said lands are in possession of parties unknown to petitioners at this time and that for the reason stated herein they desire to have a contract of employment and mortgage with their attorney TOM G. HAILE, approved by this Court and to have the said TOM G. HAILE prosecute this claim for them. Signed by: SOPHIA IMPSON. ATTORNEY'S CONTRACT OF EMPLOYMENT AND MORTGAGE. KNOW ALL MEN BY THESE PRESENTS: That this contract and agreement made and entered into on this 11th day of March, 1922, by and between SOPHIA and MINERVA IMPSON parties of the first part and TOM G. HAILE, party of the second part. WITNESSETH: That the party of the first part has this day employed the party of the second part as their attorney to undertake to recover their interest in and to certain lands hereinafter described which employment has been accepted by the party of the second part. As a consideration for services to be rendered and for services already rendered in investigating the matter, the parties of the first part agree to pay the party of the second part the sum of money equal to one-half the value of the hereinafter described lands recovered by the party of the second part for the parties of the first part and the same to be due and payable upon the determination of any litigation that might be instituted for such recovery; and the party of the first part agrees to pay to the party of the second part one-half of any money that may be received upon settlement if any should be made, the sum to be due and payable upon the consumation of said settlement in the event that suit involving said lands should be settled by compromise. But it is also understood and agreed that in the event the second party shall recover the lands hereinafter described or any part thereof then and in that event the second party is to receive for his services rendered an undivided one-half interest in said lands for the purpose of securing the payment of the fee contracted herein. Party of the first part does hereby grant, bargain and sell and convey unto the party of the second part, his heirs, and assigns and undivided one-half interest in and to the following decribed land: East half of Southwest quarter and West half of Southwest quarter of Section 22, Township 1 South, Range 15 East. Provided if matter is settled in the County Court or without filing suit 25% shall be paid to party of the second part and in that event this contract will so modified as to show one-fourth interest in lieu of one-half interest. Being the allotment of MORRIS IMPSON, Full Blood Choctaw. TO HAVE AND TO HOLD the same together with all of the tenements and appurtenances thereunto belonging forever. This conveyance however, is intended as a mortgage to secure the payment of the fee herein before contracted and is to attach to an undivided one-half interest of any and all interest that first party may own in said lands, the lands being held adverse possession to first party and this contract and mortgage is made under and by virtue of Section 2261, Revised Laws of 1910, of the State of Oklahoma. --------------------------------------------------------------------------- Case Number #497, Filed March 22, 1922. IN THE COUNTY COURT IN AND FOR PUSHMATAHA COUNTY, STATE OF OKLAHOMA. In the Matter of the Estate of MORRIS IMPSON, Deceased. ORDER APPROVING CONTRACT. Now on this the 22nd day of March, 1922, there coming on regularly to be heard the petition of SOPHIA IMPSON and MINERVA IMPSON, now BYNINGTON for approval of one certain contract of employment made and entered into on the 11th day of March, 1922, between TOM G. HAILE, an attorney, which contract provides for the carrying on of litigation necessary to establish title to the allotment of MORRIS IMPSON, deceased, and prosecute and defend all necessary suits as fully set forth in said contract and petition and having heard evidence in support of same and being well and fully advised in the premises, finds: That it is necessary and to the best interest of the estate that said heir be represented in said proceedings by an attorney and that said contract provides a reasonable fee and the Court finds that the provisions of said contract are reasonable equitable and just to the party of the first part and should be approved; that said land contracted upon is described as follows, to-wit: East half of Southwest quarter and West half of Southwest quarter of Section 22, Township 1 South, Range 15 East. WHEREFORE, it is by the Court, considered, adjudged and decreed that said contract of employment and mortgage made by SOPHIA IMPSON and MINERVA IMPSON, now BYNINGTON, parties of the first part and TOM G.
